General Terms and Conditions of Trade
1. Scope of the General Terms and Conditions:All deliveries of AWAMED GmbH (hereafter: AWAMED) to their customers (§ 13 of the Federal Civil Code of the Federal Republic of Germany) are subject to the following General Terms and Conditions:

AWAMED is a registered and certified Online-Shop and is committed to comply with the standards of Trusted Shops (available at www.trustedshops.de).
3. Offers and Purchase Contract Conclusion
3.1 The representations of products in the Online-Shop do not include any legally binding offers, but rather are invitations to the purchase of those products. All offers are valid only “while supplies last“ unless otherwise noted in the product description. AWAMED GmbH reserves the right to any errors occurring in its product descriptions and representations. Errors excepted.
3.2 By clicking on the icon “Complete Order“ in the final step of the ordering process, the customer acknowledges and accepts the purchase(s) of all his/her products in the “shopping cart“ as legally binding to AWAMED GmbH. The purchase contract is finalized through the receipt of a Proof of Purchase e-mail sent to the customer directly after AWAMED GmbH has received his/her transactions.
4. Right of Rescission from Purchase Contract/Right of Withdrawal
4.1 Consumers maintain the Right of Rescission from Contract (§ 13 Civil Code).
Cancellation Policy
Customers wishing to withdraw their purchase contract(s) can do so without specifying the grounds for withdrawal within two weeks of their purchase by providing a written statement (letter or e-mail) or by returning the product to AWAMED GmbH. The period within which the contract can be withdrawn begins with the customer s acknowledgement of the conditions of withdrawal. To ensure the period of withdrawal, a timely notification of withdrawal or the return of the product suffice. All notifications of withdraw should be directed to:

Consequences of Withdrawal from Purchase Contract
In the case of an effective withdrawal, both sides are obligated to provide and return the full amount or value of any received product(s), including interest withdrawn on purchases. If the received product(s) can not be returned completely, only in part, or only in a condition deemed irreparable or damaged, the customer is required to refund AWAMED GmbH the full value of the irreparable or damaged product(s). The relinquishment of any product(s) does not obligate AWAMED GmbH to refund the value of any product(s) if these are determined upon examination to be in a condition less intact or representative than they would have been within the retail shop of AWAMED GmbH. Obligations to refund the full value of any damaged product(s) or service(s) can be avoided by not allowing circumstances to occur that reduce the value of the product(s). All product(s) that were received as packaged and can be shipped are to be returned as shipped packages. Non-packagable product(s) will be retrieved at the customer s residence. Customers are obligated to cover all return costs when: the delivered good(s) or product(s) correspond to those good(s) or product(s) ordered; the price of the returned good(s) or product(s) does not exceed 40 Euros; the customer has not made further arrangements at the time of withdrawal from the purchase contract to pay in installments (should the value of the good(s) or product(s) be considerably high). Customers are obligated to refund the full value of any purchased good(s) and/or product(s) within 30 (thirty) days after the submission of a contract withdrawal.
Important Information
All rights of withdrawal from purchase contracts can be prematurely terminated by any other contract partners through express permission of the primary contract partner. Termination of the rights of withdrawal must occur before the end of the right of withdrawal period or can take place when the customer has personally authorized the termination of the rights of withdrawal (for example through the downloadable form).

5. Prices and Shipping Costs
5.1 All prices listed on the product pages include the mandatory, federal sales tax and other price components.
Orders above 80.- EUR within Germany and orders above 400.- EUR from countries outside of Germany will be delivered free of shipping costs.
5.2 In case of ordering via telephone, faxor individual email we have to charge a fee due to organisationally reasons in the amount of EUR 5.- for every single order. Just use the easy way of ordering at our AWAMED homepage in the internet!
5.3 In addition to the price(s) listed on the product pages, AWAMED GmbH will calculate and add shipping costs to deliveries within and outside of Germany according to the following shipping costs schedule.
Shipping costs are shown in the product lists, in the virtual shopping cart, and on the order confirmation page.

Outside of Germany: Austria, Belgium, Czech Republic, Denmark, Finland, France, Great Britain, Ireland, Italy, Luxembourg, Netherlands, Norway, Poland, Portugal, Sweden, Spain, (incl. Balearic Islands and Canary Islands) Eur 18.-. Switzerland: 19.50 EUR. Great Britain: 16.- EUR.
All additional incidental, domestic, and customs tariffs on deliveries outside of Germany are to be born by the customer.
6. Delivery
6.1 Deliveries within Germany are handled by DHL; deliveries outside of Germany are sent through the postal service and DHL.
6.2 Deliveries within Germany require approx. 2-3 business days. Deliveries outside of Germany require approx. 3-5 business days for delivery.
Variations in delivery times are referred to on the individual product websites.
6.3 Should a product(s) not be deliverable at the time of order due to insufficient supply, the customer will be notified without delay. In the case that an order cannot be delivered due to insufficient supply, the customer has the choice of waiting on the ordered product(s) or canceling his/her order. Cancelled orders will be refunded promptly and in full.
7. Payment The following means of payment are accepted by AWAMED GmbH:
7.1 Prepayment
Payment of the invoice amount to AWAMED GmbH before the product(s) is/are shipped.
To complete the payment process, a confirmation e-mail containing the necessary bank information and a demand of payment will be sent to the customer after receiving his/her order.
Prepayment offers you
a discount of 2% of the total value of your ordered products.
7.2 Debit
On the day of shipment, a debit notice/entry will be submitted to the customer s bank. First-time customers will be sent their ordered good(s) or product(s) after AWAMED GmbH has first received the invoice amount. Banks require as a rule one to two business days to process and confirm the money receipt(s). Subsequent deliveries are exceptions from the first-time order process.
In the case that a customer s bank account does not have sufficient funds to cover the cost(s) of his/her order(s), the account-issuing bank or credit institution is not obligated to redeem the cost(s) debited from the customer s account. All unsuccessful payments due to irredeemable debit notices/entries will be carried forward at the expense of the customer.
7.3 Payment on Delivery/Cash on Delivery (C.O.D.)
The customer is obligated at the time of his/her receiving the ordered good(s) or product(s) to pay the postal or delivery personnel. Deutsche Post AG / DHL charges a processing fee of 2.- EUR for payment on delivery.
7.4 PayPal
Comfortable, easy, secure, and lightning-fast describe paying through PayPal. Customers wishing to pay through PayPal need only direct their payment(s) to: paypal[at]awamed.de. Please note: For PayPal orders there's a service charge of 2.5% of your value of goods.
7.5 Credit Card
All credit card payments are processed through “Telecash“, a well-established credit-processing agency. Payment information will be relayed to the customer s credit-issuing firm on the date of shipment. To protect against identity theft and to ensure that all payments are processed without compromising sensitive credit information to third parties, AWAMED GmbH uses the widely recognized SSL-Standard (Secure-Socket-Layer-Method). SSL contains a strong and highly secure encryption system of at least 128 Bit.
Please note: For CC orders there's a service charge of 3.4%.
7.6 Customers are reserved the right to reckon payments or lost sums in two cases: that claims filed against AWAMED GmbH have been legally finalized by a judicial authority and determined in favor of the plaintiff; or AWAMED GmbH expressly recognizes the customer s right to reckon payments or lost sums.
7.7 Customers can exercise a right of retention so far as their claims follow from the same contractual relationship.
8. Reservation of Proprietary Rights All good(s) and product(s) remain the property of AWAMED GmbH until their full payment.
9. WarrantyWarranties result solely from the legal provisions. Should defects occur in any delivered good(s) or product(s) during the two-year, legally-binding warranty period, the customer maintains the right to a replacement or in the case of multiple, damaged good(s) or product(s) replacements (customer s choice of either a replacement or a repair of the defect) and -legal requirements satisfied and presented- the legal rights to a reduction in the purchase price, contract cancellation, or product(s) replacement. Customers must allow for a total of two attempts to repair the damaged product or products. If the repairs demanded by the customer are possible only through disproportionate or excessive repair costs, the customer s claim(s) to a repair will be restricted to another, less cost-excessive repair.

Process, Change, or Delete ItemAfter finding the desired product or products, customers can click on the icon “Add to My Shopping Cart“ and by doing so, place the desired product or products in their shopping cart without a commitment to purchase.
To view the contents of the shopping cart, customers can click on the icon “Edit My Shopping Cart“ or “Place My Order.“
To partially or completely delete the chosen item or items from the shopping cart, clicking on the icon “Remove from My Shopping Cart“ at the level corresponding to the product or products will delete those product(s).
Place My OrderTo purchase the product or products in the shopping cart, click on the icon “Place My Order.“
After clicking on the “Place My Order“ icon, the customer will be directed to a shopping cart overview page where the item(s) can be verified. The shopping cart overview can also be accessed by clicking on the aforementioned “Edit My Shopping Cart“ icon.
Clicking on the icon “Continue“ will bring the customer to a page where he/she will be asked for address information. All required address fields are indicated by a *.
Registration is not required.
All information entered during the ordering process will be securely transmitted to our servers.
Following order placement, clicking on the icon “Continue“ will lead to the next page where delivery and payment methods can be selected.
By clicking on “Continue“ after selecting the delivery and payment methods, the last page of the ordering process will be called up.
After validating all information entered during the ordering process, clicking on the icon “Finalize My Order“ certifies that the customer has completed his/her order and consents to the General Terms and Conditions.
All information entered during the payment transaction will be sent to the customer per e-mail.
Order by Fax As an alternative, order forms can be downloaded from the internet and sent by fax.
Customers need only fill out the necessary information in legible handwriting (ink is preferred) and send the order back.
Order by PhoneOrders can be taken over phone, but require personal information to complete the order process. After the order has been taken down, a confirmation e-mail will be sent to the customer.
Contract TextContract texts are downloaded and saved onto our internal servers. The General Terms and Conditions can be downloaded by the customer anytime on this website. Order information will be sent to the customer per e-mail. For reasons of security, contract texts are not accessible after the conclusion of a contract.
Data ProtectionAWAMED GmbH uses data entrusted to us by the customer exclusively for the purpose of processing and completing orders. Disclosure of data to the firm responsible for delivery occurs only to the extent that the data is necessary for the delivery (name, address, and perhaps telephone number to confirm a date of delivery). As the case may be, payment data is forwarded to our house bank for payment processing purposes.
Customer data will not be forwarded or sold to third parties.
After the processing of a customer s contract and completion of payment, customer data will be saved for further use. Customer data will be deleted upon expiration of the tax and trade regulations concerning customer data.
The customer has the opportunity to subscribe to our newsletter by entering his/her information where requested. Information entered for a subscription to our newsletter will be saved, after which the customer will receive an e-mail newsletter at irregular intervals containing our latest offers. Customers can cancel their subscription to the newsletter anytime.
By canceling a subscription to the newsletter, all subscriber data for the newsletter will be automatically deleted.
